Jonathan Pincus is an Associate based in New York City, where he lives with his wife and son. He earned his Bachelor of Arts, cum laude, from Brandeis University and received his Juris Doctor from Boston College Law School.
Mr. Pincus has practiced law in New York since 2015 and is admitted to practice before the New York State Bar and the United States District Court for the Southern District of New York.
Before joining Fixler & LaGattuta, LLP, Mr. Pincus worked at a mid-sized civil litigation firm in New York City, representing defendants and insurance carriers across a wide range of matters, including personal injury, premises liability, motor vehicle accidents, construction accidents, and wrongful death claims. He also has experience defending insurance carriers in No-Fault coverage disputes with health care providers.
At Fixler & LaGattuta, LLP, Mr. Pincus represents insurers, insureds, property owners, managing agents, contractors, and commercial tenants in complex liability and insurance coverage matters. He regularly serves as day-to-day handling counsel on cases involving multiple parties, third-party actions, and overlapping coverage issues.
His practice includes the defense of claims involving:
- New York Labor Law and construction site accidents
- Premises liability, including alleged structural and transient defects
- Property damage claims
- Motor vehicle, multi-vehicle, and commercial automobile accidents
- Restaurant or bar liability claims arising from customer injuries
- Professional liability claims
- Insurance coverage disputes and declaratory judgment actions involving coverage determinations
Mr. Pincus has achieved favorable results in high-exposure personal injury and Labor Law matters, including the dismissal of owners, operators, employers, and third-party defendants based on statutory defenses, lack of notice, contractual limitations, and coverage determinations. He has particular experience handling third-party actions, indemnification disputes, and coverage issues arising from construction and premises liability claims.
Mr. Pincus manages matters from pre-litigation through trial and advises clients on early risk assessment, strategic motion practice, and resolution planning aimed at minimizing exposure and litigation costs. He works closely with claims professionals to ensure litigation strategies align with coverage positions, exposure analysis, and cost-containment objectives.
