Mr. Fixler has extensive experience handling construction and labor law claims as well as premises liability claims and both first and third party automobile claims.
He has also developed expertise in handling premises and garage liability claims and, in this area, handles a majority of cases brought in this jurisdiction against New York’s largest parking garage management company. For parking facility management companies, property owners, lessors and lessees, Mr. Fixler has successfully defended claims involving:
- Labor Law violations;
- Personal injuries for slip/trip and falls over areas designated as “special use”;
- Third party actions for contractual indemnification;
- Building owners, lessors, lessees for personal injuries, including wrongful death, allegedly resulting from malfunctioning elevators;
- Assault, wrongful arrest and, malicious prosecution against attendants working in the course of their employment;
- Civil rights violations against corporations and their officers;
- Passersby who allegedly sustained personal injuries as the result of construction site operations.
- Personal injuries sustained as the result of alleged negligent/reckless operation of motor vehicles.
- Attorney’s alleged failure to comply with notification guidelines in residential contract of sale.
- Broker’s failure to timely notify general contractor’s carrier of accident resulting in death of subcontractor’s employee.
- Property damage to bailed property.
He has also obtained directed verdicts in both an action for an alleged faulty construction of an internal stairwell and a Federal action for alleged violation of civil liberties, and has garnered favorable results through motion practice and appeals, recently obtaining pretrial dismissals of premises liability claims in Bronx, Queens and New York Counties and contractual indemnification in New York County.
Before joining Fixler & Associates, Mr. Fixler worked as a Property and Casualty Underwriter of commercial line primary and excess insurance for American International Group (AIG) in Manhattan.
